Terms & Conditions
General
This is a legally binding contract between the property owner, Simon Baldwin and the holidaymaker. This contract will be governed by English contract law. The property owner and their property manager or agent is also referred to as “we” and “us”.
The holidaymaker is the person who signs the booking form or, in the case of online booking, the person who makes the online payment. This person is responsible for ensuring all members of the holiday party (group) accept and adhere to these terms and conditions. The holidaymaker is also referred to as “you”.
The property referred to being 4 Malthouse Cottages.
Bookings
A booking deposit of 50% of the total rental value is payable within 2 days of the provisional booking being taken. The booking is taken on a provisional basis until the deposit has been paid in full and funds cleared through the banking system (where appropriate). The booking then becomes confirmed. Until the booking is confirmed, it can be cancelled at any time without prior notice.
The balance of the rental charge, along with the breakage deposit of £200, is payable not less than 8 weeks prior to the start of the holiday. Failure to pay the deposit or balance in full by the due dates will constitute a cancellation of the holiday by the holidaymaker. Please be sure to note the due dates of these payments as reminders are not routinely issued.
Bookings made less than 8 weeks prior to the arrival date must be paid in full at the time of booking.
You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.
Cancellation by the Holidaymaker
Cancellation of the booking by the holidaymaker should be made in writing and addressed to:

In the event of a cancellation we will attempt to re-let the property and if successful, a discretionary payment may be made.
We strongly recommend you take out holiday cancellation insurance.
Cancellation by the Property Owner
The property owner will endeavour to make sure the stated property is available for the dates contracted. In the unlikely event that the property becomes not available and the property owner has to cancel the booking the holidaymaker shall be entitled to a full refund. The property owner shall only be liable to return the monies received. No compensation or other consequential losses shall be paid.
Number of Holidaymakers
The maximum number of people (excluding an infant as defined below) entitled to stay at this property is 5 and furthermore, only those people named on the booking form are entitled to stay. If it is found that more people than agreed are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund.
In addition to the 5 holidaymakers we are happy to accommodate one additional infant. The infant must be able to be accommodated in a travel cot, used in the main bedroom, and use a highchair. We have a travel cot and high chair available and these will be put up on request.
Sub-letting or assignation of the let is prohibited.
Arrival and Departure Time
Every effort will be made to have the property available from 16:00 on the day of arrival. The property must be vacated by 10:00 on the day of departure.
Late departure will result in an additional daily charge being made based on the average of the booking.
Information about keys and how to collect them will be provided once full payment has been received.
Car Parking and Car Charging
There is space for two cars to be parked on the gravel driveway in front of the trellis. If you have a third car this can be reversed towards the wood store. Allowing the two cars in front of the trellis easy reversing off the drive.
We charge a fee for use of the electric vehicle charger, as defined on our website. Vehicle charging will be made available for a defined period during the early hours of the morning. This may vary from time to time based on tariff changes which may or may not be within our control.
Under no circumstances is a ‘granny charging lead’ to be plugged into 13A sockets within the property.
Pets
Pets are allowed in the property subject to the property owner’s agreement and a maximum of 2 pets. All pets must be house trained and the number and type of pet must not exceed what was agreed at the time of booking, otherwise a breach of contract will be deemed to have taken place.
Pets must not be left unaccompanied in the property at any time.
Pets are not allowed, under any circumstances upstairs, on the beds or on any furniture.
The holidaymaker shall be liable for all damage caused by his/her pet or any pet belonging to the holidaymaker’s party. A charge will be made for any additional cleaning required.
Damage to furniture, linens, towels or other furnishings caused by pet claws, muddy paws or oils from paws from experience does not wash out or repair. Where these item(s) need to be replaced this will be recharged to the holidaymaker.
We make available at our sole discretion dog towels, two large stainless steel dog bowls and a limited number of dog treats. The holidaymaker must bring with them any pet beds or blankets as required.
By prior request a large dog crate can be made available, this is stored outside in the bike store and if used requires the blanket is required to be always kept under it so as not to damage the flooring. The crate works best in front of the front lounge window.
The garden, yard area, and entry way all have gates provided, this encloses the outdoor areas. The holidaymaker is responsible for ensuring that your pets do not stray outside of the enclosed area. There is a right of passage for our neighbours (1, 2 and 3 Malthouse Cottages) across the enclosed yard area and use of the entry way, please ensure that they can pass without let or hindrance. Pets can sometimes be startled and react in an uncharacteristic manner, which can cause alarm. You are responsible for the behaviour of your pet.
We do understand that pets shed hairs, however at times when some dogs malt, the odd hair can turn into a deluge. We do provide a vacuum cleaner for your use.
Holidaymakers are required to clean up pet mess (faeces/poo) in a timely manner in order to prevent it being trodden around. In any case holidaymakers are required to fully clear the garden and property outside areas of pet mess before departing. Any clearance by the property owner will incur additional recharges to the holidaymaker.
The property owner cannot be held responsible for any accident or injury to a pet during their stay.
Cleaning, Towels and Bed Linens
We would like to think the holidaymaker and party would treat the property as they would their own home and at the end of the holiday the property is left in a clean and tidy condition. The property owner retains the right to make an additional charge for cleaning should the property not be left in a similar condition to the way that it was found at the start of the holiday.
We provide high quality white cotton sheets and towels for holidaymakers use. We ask that you make sure that substances such fake tan, nail varnish, make up or sun cream do not mark the bedding or towels. Should we have to dispose of sheets or towels due to soiling we will recharge fully for replacement items. We do accept that accidents can happen, if this is the case please do let us know at the earliest opportunity.
If you have any spillages of liquids or other damage to beds, sofas or carpets please report this to the property owner (or their representative) at your earliest opportunity. We can then arrange for a professional cleaner to visit the property during your stay in order to resolve the issue for your continued enjoyment and that of our subsequent holidaymakers. Please do not scrub fabrics or carpets as this can cause irreparable damage. We reserve the right to recharge any expense incurred at our sole discretion.
Breakages
The holidaymaker should make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday.
Any accidental dame or breakages should be reported to the property owner (or their representative) prior to departure.
The property owner retains the right to make an additional charge for damage and breakages although it should be noted that minor breakages and reasonable wear and tear (in the opinion of the property owner) will not be charged for.
Complaints
Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, we do recognise that from to time things do go wrong. In these circumstances, it is the responsibility of the holidaymaker to make any such problem known to the property owner (or their representative) immediately it becomes apparent, thereby giving the property owner the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained.
The property owner will make every endeavour to rectify any identified problems as soon as is reasonably possible.
Return of Breakage Deposit
Your breakage deposit, minus any deductions, will be returned to you within 2 weeks of the departure date.
Holidaymaker Safety
All appliance instructions are provided in a folder in the lounge cupboard. You should familiarise yourself with these as required.
Holidaymakers should not use the log burner without familiarising themselves with the instructions provided in the lounge cupboard. At all times when the log burner is in use it should be operated with doors closed except when preparing or refilling with fuel. The door vents and baffle are used to control air airflow, thus regulating the fire. Operating the log burner with the doors open is outside of the fire risk assessment and is prohibited. Holidaymakers should observe the thermometer fitted above the stove to the chimney connector. The stove should never be operated in the ‘TOO HOT’ zone. The provided fire guard should be used to prevent contact with the log burner by persons or pets. The guard also protects from sparks which occasionally are emitted from the vents.
Smoking and vaping is prohibited anywhere inside the property. Smoking and vaping is permitted outside of the property, but under no circumstances in the entry where the large red LPG gas cylinders are stored. Notices are posted at the cylinders and this should be strictly adhered to. Holidaymakers are required to deposit cigarette ends in the bins provided.
Holidaymakers are required to familiarise themselves with the fire exit plan located in the holidaymaker information folder. Holidaymakers are required to close the lounge doors at night as a fire safety precaution.
The use of candles is prohibited within the premises.
A first aid kit is provided for your use, exit lights are provided to the landing, hall and lounge. Smoke and Heat detectors are provided in bedrooms, hall and landing. Heat detector in the kitchen. The lounge and middle-sized bedroom are provided with a Smoke, Heat and CO2 alarm.
Holidaymakers are required to supervise the barbeque whist it is in use at all times. Instructions provided in the holidaymaker information folder are required to be followed. Lighting the gas with the lid down could cause an explosion and should never be done.
Liability
The property owner will not be liable for any accident, damage, loss, injury, expense, or inconvenience, whether to person or property, which the holidaymaker or any other person may suffer or incur arising out of, or in any way connected with, the booking unless the property owner is responsible.
The property owner accepts no liability for loss of, or damage to, the holidaymaker’s possessions on the property owners land or in the property.
Nothing in these terms and conditions excludes or limits the liability of the property owner for death or personal injury caused by negligence of the property owner, or any matter which it would be illegal for the property owner to exclude or attempt to exclude their liability.
Holidaymakers are liable for loss and damage caused to the property, its contents, and the property owners property or land to the full value of the property owners loss even though the value of the loss exceeds the Damage Deposit.
Miscellaneous
Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.
The property owner reserves the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required.
The property owner is entitled to ask the holidaymaker to leave the property without any refund if, in the property owner’s opinion, the behaviour of the holidaymaker and/or his/her party is unacceptable.
The property owner reserves the right to refuse entry to anyone, who in the property owner’s opinion is not suitable to, or capable of taking charge of the property.
The property owner reserves the right to ask the holidaymaker and their party to leave the property, without refund, should the behaviour of the holidaymaker and/or their party be considered by the property owner to be unreasonable.
Wi-Fi is provided for the holidaymaker’s reasonable use. The holidaymaker agrees to reasonable and lawful usage of this service.
Keys must be returned to the keysafe on your departure. Loss of keys will incur a charge for replacement to include key cutting and delivery. All of these charges will be recharged plus a £25 administrative fee.
Data and Privacy
The property owner is committed to protecting the privacy of our holidaymakers. The property owner will only use the information that it collects about the holidaymaker and the members of their group lawfully, in accordance with the Data Protection Act 2018.
When a holidaymaker makes a booking, the property owner will ask for personal information such as their name, postal address, email address, telephone number and payment details.
The property owner may use such data to inform the holidaymaker or members of their group about news and information we think may be of interest to them.
The property owner will not pass information of the holidaymaker or members of their group onto any third parties, except as necessary. For instance, cleaning or property management personnel who act on behalf of the property owner may require the holidaymaker’s contact information to confirm check-in time and to communicate key collection details.
Upon making a confirmed booking, the holidaymaker is deemed to have consented to the use of personal information for the purposes of holidaymaker communication and marketing relevant content to them.
The holidaymaker has the right to request a copy of all information the property owner holds on them and the right to unsubscribe from any marketing emails that may be sent to them.
